Heroin suspect Church faces old charge

EFFINGHAM — While the trial for one of the two men charged in connection with a recent heroin-related death has been delayed until June, Albert D. Church isn't done with court until then.

Church, 23, has been ordered to appear in the Effingham County Problem-Solving Court Friday in connection with a petition to revoke his probation on a 2013 aggravated assault conviction. Effingham attorney Bill Totten entered his appearance Monday on behalf of Church in both the old and new cases.

Church has been jailed since early last month on a charge of delivery of a controlled substance. The Effingham resident is charged under the legal theory of accountability in connection with heroin received by Jessica James, 29. James died Feb. 5 from what authorities believe was a heroin overdose. Church and co-defendant Jay C. Miller are both charged with heroin-related offenses, though not specifically in connection with James' death.

Judge J. Marc Kelly set a pre-trial date of 11 a.m. May 5 on the new charge, with jury selection set for 8:30 a.m. June 2.
