St. Elmo woman sentenced in child's death case

VANDALIA — A St. Elmo woman who plead guilty in the death of her 1 year-old child was sentenced in Fayette County Court Thursday.

Heaven Davis, 24, stood before Judge Allen Bennett, for a sentencing hearing. Davis had previously taken a negotiated guilty plea at a hearing in May in the death of her child Addison Scott.

Bennett sentenced Davis to three years in the Illinois Department of Corrections with one year of mandatory supervision after her release. Davis was also credited for 29 days of time served.

Davis allegedly put her daughter to bed on the night of Jan. 21 before smoking marijuana and going to sleep. She woke up several times in the morning and was awoken at 11:08 a.m. on Jan. 22 by her three-year-old daughter who said that Scott was in the bathtub. Scott was then discovered submerged in water. She was declared dead at St. Anthony's Memorial Hospital later that day.

Fayette County Assistant State's Attorney Amanda Ade-Harlow had asked for a five year sentencing for Davis and said she was unsurprised by the ruling.

"What makes it really difficult is when you have crimes where there's a victim, we judge the crime based on how the victim feels," she said. "We can't ask the victim here because they're gone. It's fair and it's reasonable I suppose."

Davis will report to Fayette County jail on July 31 before being transported to the Department of Corrections.
