EFFINGHAM — Kelci Niemerg was headed back to prison Friday afternoon after Judge Kimberly Koester denied a defense motion to reconsider her five-year sentence for permanently injuring a child in her care.
Niemerg, 26, had pleaded guilty April 4 to aggravated battery in connection with injuries caused to infant Nathan Dill in the spring of 2011. Nathan suffered severe brain damage after Niemerg admittedly "slammed" him into a playpen while he was in her care.
Koester had sentenced Niemerg to five years in prison on June 7, even though she was pregnant with her third child at the time. The baby was born earlier this week, defense attorney Timothy Capps said during Friday's hearing.
The judge noted that Niemerg was eliglble for parole in slightly more than two years.
